These Terms of Service (“Terms”) govern your use of Kidsplorer (the “Service”). By creating an account or using the Service, you agree to these Terms.
1. Accounts and authority
You must be at least 18 and able to form a binding contract to create a guardian or administrator account. If you use Kidsplorer for an organization or for children in your care, you confirm that you have authority to do so and to manage the information you enter.
Children may use the Windows application under an adult-managed profile but may not create dashboard accounts. You are responsible for account credentials, profile PINs, and activity performed through your account.
Before creating or connecting a child profile, you must review the Children’s Privacy Notice , confirm that you are authorized to act for the child or organization, and provide the requested consent. You may withdraw consent as described in that notice, although doing so may require us to disconnect the related device or close the profile.
2. What the Service does
Kidsplorer is a Windows browser and web dashboard that enforce adult-selected website rules and, on paid plans, schedules and additional device controls. You are responsible for reviewing approved sites, maintaining Windows accounts and devices, and deciding what is appropriate for each user.
An approved domain can change or contain embedded content. Kidsplorer does not review or guarantee the safety, accuracy, educational value, or legal status of third-party content.
3. Plans and limits
Free includes one Windows device, one profile, 10 age-range starter sites, and up to 10 custom sites. Family supports up to five devices and five profiles and adds schedules, email requests, activity history, and paid device controls. Labs supports purchased capacity and adds organization administration features.
Feature availability and technical limits are shown on the Pricing page and in the dashboard. We may change features or limits, but will provide notice when a material change affects a paid subscription.
4. Billing and cancellation
- Family is billed monthly or annually and renews automatically until canceled.
- Labs is billed monthly or annually for purchased device capacity.
- Applicable volume discounts and the complete amount appear before checkout.
- Taxes may apply.
- You may cancel through the Stripe Customer Portal. Cancellation stops the next renewal; paid access continues through the current billing period.
- Payments are non-refundable after a billing period begins except where applicable law requires otherwise.
- When paid access ends, the organization moves to Free limits. A disconnected device may temporarily use its last configuration before Free limits are applied at a later sync.
Stripe processes billing under its own terms.
5. Acceptable use
You may not use the Service to violate law, harm another person, bypass security or plan controls, interfere with the Service, distribute malware, or gain unauthorized access. You may not reverse engineer or redistribute the software except where applicable law expressly permits it.
We may suspend or terminate access for a violation, unpaid service, or a material legal, security, or operational risk.
6. Deployment and safety responsibilities
Kidsplorer controls navigation within its application. It is not a network-wide filter, antivirus product, emergency service, or substitute for adult supervision. Other browsers and applications require separate Windows, device-management, or network controls.
The app’s lock and app-switch restrictions are intended for standard Windows accounts and can be changed or removed by an administrator-level user. No access-control product is bypass-proof.
Schools, libraries, and other organizations remain responsible for their policies, notices, consent, supervision, accessibility, records, and compliance obligations. Kidsplorer does not certify compliance with CIPA, COPPA, or any other law.
7. Your data and privacy
You retain rights in information you provide, including profile labels, approved-site rules, and schedules. You grant us the limited rights needed to host, process, transmit, and back up that information to operate and support the Service.
Our Privacy Policy explains what we collect, how we use it, retention periods, and service-provider categories.
8. Intellectual property
Kidsplorer and its licensors own the Service, software, branding, and documentation. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.
9. Service availability and changes
We may maintain, update, modify, or discontinue parts of the Service. Internet, Microsoft Store, email, and third-party service interruptions can delay configuration sync, notifications, billing, or updates. We do not guarantee uninterrupted or error-free operation.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes rights that cannot legally be excluded.
11. Limitation of liability
To the maximum extent permitted by law, Kidsplorer is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability related to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or USD $100 for a Free account.
12. Indemnification
You agree to indemnify and hold Kidsplorer harmless from claims, damages, and reasonable expenses arising from your unlawful use, violation of these Terms, or violation of another person’s rights, to the extent permitted by law.
13. Governing law
These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law rules. Mandatory consumer protections in your jurisdiction continue to apply where they cannot be waived.
14. General terms
These Terms and the Privacy Policy are the agreement between you and Kidsplorer regarding the Service. If one provision is unenforceable, the rest remain in effect. A failure to enforce a provision is not a waiver. We may assign these Terms with a reorganization or transfer of the Service; you may not assign them without our consent.
